NELP – Independent Reviewer and Environmental Auditor Services for North East Link
Purpose of the Tender
North East Link Project (NELP), a division of the Major Transport Infrastructure Authority (MTIA), is seeking to procure an Independent Reviewer and Environmental Auditor (IREA) services provider for North East Link (NEL).
The opportunity will be provided via an open tender.
Contract award and commencement of the services is expected in late 2020.
NEL is Victoria's priority road project and will be the single biggest investment in road transport infrastructure in Victorian history. NEL will be delivered via an early works package, one Primary Package and several Secondary Packages. The early works package does not form part of this opportunity.
The Primary Package will be procured and delivered as an ‘availability’ Public Private Partnership. Project Co (the party contracted to deliver the Primary Package) will be responsible for the design, operation and maintenance of the entire NEL corridor (including the Secondary Packages) and the construction and financing of the Primary Package. The construction of the Secondary Packages will be separately procured and financed by the State.
To provide independent assurance that the project requirements are being met, an IREA will be appointed.

The State is seeking to engage a service provider to be the IREA for the works undertaken by Project Co.
The scope of services for the independent reviewer component of the role will need a project-management led approach to deliver independent, objective and compliance led general overview and reviewing for the benefit of both Project Co and the State. For the Primary Package, this will include certifying compliance with the contract documents, targeted review of design documentation, monitoring of project plans and programs, surveillance of the construction works, providing defects notifications, notifications of achievement of development phase milestones, and certification of commercial acceptance. For the Secondary Packages, the independent reviewer role will include targeted review of design documentation and other related documents prepared by Project Co, determinations regarding design change during construction, and assessment relating to completed construction for the purposes of the Primary Package.
The service provider will also be engaged as the independent environmental auditor for the Primary Package and the Secondary Packages. Service obligations will include review of documentation and audit compliance against environmental approvals and other project requirements.
The service provider will be engaged under an IREA Deed of Appointment aligned to the Primary Package Project Deed. The State’s Local Jobs First Policy and Social Procurement Framework will apply to this opportunity.
The Tender Process for the appointment of the IREA will consist of a two-stage process:
- an Expression of Interest Phase; and
- a Request for Proposal Phase.
The State intends to apply the following requirements to the procurement of the IREA for the purposes of promoting competition and innovation, and to provide value‑for-money:
- subject to paragraph 2, proponents for the IREA role may comprise of a consortium (IREA Consortium);
- if an IREA Consortium includes an entity participating in the procurement process for NELP’s Primary Package (Primary Package Procurement), that IREA Consortium must not include any entity from another respondent participating in the Primary Package Procurement;
- unless otherwise agreed by the State, the State will not award the IREA services contract to an IREA Consortium which contains a Primary Package Participant who is a member of, or who is a related entity to a member of the successful respondent for the Primary Package; and
- unless otherwise agreed with the State, current State advisors are ineligible to bid for the IREA services or be part of an IREA Consortium.
The State intends to hold an Industry Briefing during May 2020 for interested service providers. With the current COVID-19 pandemic and in line with government directive and advice from Victoria’s Chief Health Officer, the Industry Briefing may be subject to deferral or presented as a virtual briefing.

- Company Name: Provide the name of the company proposing to be involved in the tender process for NELP - IREA Services; and
- Key Contact: Provide the name of the proposed Key Contact for the NELP - IREA Services, their contact telephone numbers and email address.
The State is continuing to develop, and reserves its rights to amend, its approach, timing and requirements in respect of the IREA procurement.
